Anthropic called out China for copying its homework — but the legal ground is murky

Anthropic’s accusation. Last week, Anthropic accused three Chinese AI labs (DeepSeek, Moonshot AI, and MiniMax) of using 24,000 fake accounts and 16 million exchanges to run coordinated distillation attacks. The problem? Distillation is technically a legal training technique.
What is distillation? Distillation is when a smaller model is trained on the outputs of a larger, smarter model, helping it match performance for a fraction of the price. For example, Stanford and University of Washington researchers used distillation to replicate OpenAI's o1 reasoning capabilities last year for under $50. Both Anthropic and OpenAI believe Chinese labs are doing this at industrial scale — which explains the timing of open-source releases.
The 3-month lag. Open-source models have consistently trailed frontier models by 3 months on average. During that gap, competitors are likely using the frontier model's outputs as training data to replicate months of research for pennies on the dollar. As Databricks CEO Ali Ghodsi puts it: distillation is "so extremely powerful and so extremely cheap, and it's just available to anyone."
Sparking a geopolitical showdown. Anthropic and OpenAI think China’s approach to distillation presents a national security threat: large-scale intellectual property (IP) extraction by a foreign adversary. But the legal ground is murky — especially when many frontier models were trained on data that wasn’t theirs in the first place.
